Full Recovery Mandate

Freezing, disclosure and enforcement across jurisdictions. Independent cross-border & crypto asset recovery from Axiom Trace.

By 16 min read

A judgment or award sits on paper while the debtor's assets move. That gap – between winning and collecting – is where most cross-border recoveries are decided. The Full Recovery Mandate is the service Axiom Trace runs when a client needs the entire chain: trace, freeze, disclose, enforce.

A Full Recovery Mandate combines forensic asset tracing, urgent interim relief, multi-forum disclosure, and the enforcement of judgments or arbitral awards into a single coordinated engagement. It applies when the target's assets are dispersed across jurisdictions, when dissipation risk is live, or when a single-tool approach – a standalone freezing order, a disclosure application alone – cannot reach all of what is owed.

This page sets out what the mandate covers, when it applies, how the process runs, and where the honest limits lie. It is written for defrauded principals, insolvency practitioners, and referring lawyers who need to assess whether this level of engagement is appropriate for their matter.

What Does a Full Recovery Mandate Cover?

A Full Recovery Mandate is active coordination of every stage from initial tracing to final enforcement. It is not an advisory retainer or a referral to local counsel. We run the process, manage the timeline, and ensure that actions in one forum do not undermine or contradict actions in another.

The work falls into four interlocking phases. First, forensic tracing: reconstructing where the assets went, through which vehicles, and where they currently sit. Second, interim relief: obtaining a worldwide freezing order, a proprietary injunction, or equivalent urgent measures in the forum or forums where the assets are reachable. Third, disclosure: Norwich Pharmal orders, Bankers Trust orders, and third-party disclosure against banks, trustees, or virtual-asset service providers (VASPs) that hold or have passed through the funds. Fourth, enforcement: converting a judgment or arbitral award into a measure that compels payment or transfers control of the identified assets.

In our experience, matters requiring a full mandate rarely fit a single jurisdiction. The fraudster may be domiciled in one place, the assets held in another, and the operating company incorporated in a third. Each forum has its own procedural demands. Keeping those threads aligned – so that a freezing order in one court does not expire before enforcement is obtained in another – is the operational core of what we do.

If funds have already moved and the target's asset base is not yet mapped, time matters – request a confidential case review at info@axiomtracel.com.

When Does a Full Mandate Apply?

Not every matter needs this level of engagement. The test is whether the complexity of the asset structure, the number of jurisdictions involved, or the urgency of dissipation risk exceeds what a narrower instruction can manage. Some matters call for a monitoring retainer or a targeted disclosure application. A full mandate is the right tool when the situation meets one or more of the following conditions.

Multiple jurisdictions are live at once. The assets – cash, real property, digital assets, shareholdings – sit in more than one place. Separate local instructions, uncoordinated, will miss timing dependencies between forums. A freezing order in one jurisdiction may need to be served before a parallel order is sought in another; the sequencing matters and someone must own it.

Dissipation is active or probable. The target has previously moved assets at speed. Corporate layers or trust structures are in place that could quickly place assets beyond reach. In that environment, the window between identification and effective freezing can be measured in days – or less. We regularly advise clients that by the time a winding-up petition or enforcement proceeding is filed conventionally, the asset base has already shifted.

A judgment or arbitral award exists but has not converted to payment. Winning is not collecting. A judgment from one jurisdiction does not automatically freeze or attach assets held elsewhere. Enforcement requires recognition proceedings, and those proceedings take time – during which the debtor may act. The mandate runs enforcement alongside the tracing so that relief is ready when recognition is obtained.

The target's asset base includes digital assets. Crypto recovery has its own timing pressures. On-chain movements are traceable even when identities are hidden, but the window between movement and cash-out can close fast. A mandate that reaches a centralised exchange or VASP disclosure order, or engages a stablecoin issuer to freeze a specific balance, requires a different operational track than conventional banking-layer recovery.

What a mandate does not replace: admitted local counsel who must file and appear in court. Axiom Trace coordinates proceedings and drives the strategy; local counsel in the relevant jurisdiction handles the filings and court appearances. That distinction matters for the client's costs assessment.

How Does the Mandate Process Work?

The process begins with a triage assessment – usually within hours of instruction. The assessment identifies the probable asset location, the applicable forums, the instruments available in each, and the sequencing that best protects the client's position. Speed here is not theatre; a without-notice application for interim relief depends on the court being approached before the target is aware.

Phase one is forensic mapping. We reconstruct the payment trail using banking records, corporate registry searches, UBO register disclosures, and blockchain-analytics tools where digital assets are involved. The goal is a working hypothesis of where assets sit and in what form, sufficient to ground an application for urgent relief. This phase can run in parallel with legal preparation; the two tracks inform each other.

Phase two is urgent interim relief. Depending on the forum, this may be a worldwide freezing order, a proprietary injunction, or a Chabra order against a third party holding assets as a nominee. A freezing or disclosure application is typically made without notice to the defendant to avoid tipping off the target and triggering dissipation. Gagging orders, which prevent the application being disclosed to the target for a defined period, are sought where the risk of flight is acute.

Phase three runs disclosure in parallel with the freeze. Norwich Pharmal applications against banks, trust companies, or VASPs fill gaps in the asset map. Bankers Trust orders compel specific account disclosure. Where the assets include digital holdings, a disclosure order against a centralised exchange can produce wallet attribution data that then grounds further tracing. We have traced funds through three intermediary exchanges in a single matter – each disclosure round sharpening the picture before the next application.

Phase four is enforcement. If a judgment or arbitral award is already in hand, recognition proceedings are initiated in the jurisdiction where the assets sit. The New York Convention supports recognition and enforcement of arbitral awards in most states – but it does not make enforcement automatic. Local procedure governs, and local counsel acts. Charging orders, garnishee or attachment proceedings, and the appointment of a receiver are the usual instruments at this stage.

Throughout, Axiom Trace holds the strategy and the timeline. Each step is planned against the others. An enforcement order in forum A should not expire before the tracing disclosure in forum B is complete. That coordination is the thing a client cannot reliably achieve by instructing separate counsel in each jurisdiction independently.

The Cross-Border Dimension: Where Does Recovery Break Down?

Cross-border recovery breaks down at the transition between forums – not within any single jurisdiction, where the law is usually adequate, but at the border. Four failure modes recur.

First, sequencing errors. A client obtains a freezing order in jurisdiction A before establishing that the assets have already moved to jurisdiction B. The order is technically valid but practically useless. Jurisdiction B proceedings must then start from scratch, and the window to catch the assets may have closed. The remedy is parallel-forum monitoring from day one, with relief sought in the jurisdiction closest to the money, not the jurisdiction where the judgment was obtained.

Second, disclosure gaps. An asset trace based only on banking records misses assets held through bearer shareholdings, nominee directors, or on-chain. The mandate explicitly addresses this: corporate registry searches, UBO register enquiries, and where appropriate, the appointment of a liquidator or receiver to compel internal disclosure from the target entity. Just-and-equitable winding-up is one route to access that internal record.

Third, enforcement timing. A judgment creditor who waits until after the recognition proceedings are concluded to begin tracing often finds the asset base has thinned. In our experience, the best practice is to begin enforcement preparation before the final judgment, treating the award or judgment as a trigger to accelerate what is already underway – not as the starting gun.

Fourth, digital asset delay. A claimant who treats a crypto element as secondary, intending to address it after the conventional banking layer is resolved, frequently arrives too late. Funds moving on-chain do not observe banking hours. A stablecoin issuer can, on appropriate legal process, freeze a specific token balance – but only if the request reaches the issuer before the tokens are converted or bridged. That window is measured in hours, not weeks.

Are there matters where a full mandate is not appropriate? Yes. Where assets are held in a single jurisdiction and the target is not moving them, a targeted enforcement instruction with local counsel may be sufficient. The mandate's added value is in the coordination function; where there is nothing to coordinate, the cost of running it does not produce commensurate benefit. We will say so at the triage stage.

What Instruments Does the Mandate Use?

The mandate draws on the full range of interim and enforcement instruments. Which instruments apply depends on the forum, the nature of the assets, and the stage of the matter. The following is not an exhaustive list; it is the working vocabulary of a cross-border recovery.

On the interim side: a worldwide freezing order, where the court has jurisdiction and the assets or the defendant have the right connection to the forum; a proprietary injunction, used where a trust or fiduciary claim over specific assets can be established; Chabra relief, which reaches third parties who hold assets for the defendant without themselves being the primary wrongdoer; an anti-suit injunction, where parallel proceedings elsewhere risk frustrating the primary relief.

On the disclosure side: a Norwich Pharmal order against a third party who, without being a wrongdoer, holds information needed to identify the defendant or the assets; a Bankers Trust order against a bank that has held or processed the funds; third-party disclosure against a trust administrator, VASP, or nominee director; and where digital assets are the subject, a disclosure order against a centralised exchange producing wallet and KYC data.

On enforcement: recognition and enforcement of foreign judgments, recognition of arbitral awards under the New York Convention, charging orders against shares or land, garnishee or attachment proceedings against bank accounts, and the appointment of a receiver to take control of assets pending satisfaction of the judgment. Where the corporate structure is itself the instrument of fraud, piercing the corporate veil and unwinding nominee or sham-trust arrangements are part of the same proceeding.

In matters involving digital assets, the mandate also encompasses service of proceedings by NFT or airdrop against unknown defendants – an instrument available in certain common-law courts – and engagement with stablecoin issuers to freeze identified balances while legal process catches up with the movement of funds.

What Are the Honest Limits?

A full mandate is not a guarantee of recovery. The outcome depends on whether assets remain reachable, whether the relevant courts are cooperative, and whether the target's asset base exceeds the cost of pursuing it. None of those variables is within our control.

Some matters are simply not viable at the point of instruction. Assets may have been cashed out, mixed beyond practical trace, or moved to a jurisdiction where enforcement is functionally impossible on the timeline available. At the triage stage we say this plainly. Pursuing a mandate against an asset base that no longer exists is not recovery – it is cost.

The mandate also does not replace local admitted counsel. In every jurisdiction where a court filing is made, local counsel acts. Their fees are separate from the Axiom Trace engagement. Where proceedings must be filed, the client needs to understand that two sets of professionals are involved: the tracing and coordination function (Axiom Trace) and the admitted advocate before the court (local counsel in the relevant jurisdiction). We work closely with both; we do not represent one as replacing the other.

Timing is a constraint, not a variable. A freezing order sought six months after dissipation is not a freezing order – it is a damages claim against an empty box. Urgent applications are measured in hours to days; the mandate is built around that reality. Clients who delay instruction after discovering a loss reduce their own options, sometimes irreversibly. We say this not to alarm but because it is accurate.

Is recovery from a fraudster who has used layered offshore structures always slower? In our experience, yes. Nominee structures, trust layers, and shell company chains each add a round of disclosure before the underlying asset is reachable. A mandate running against a complex structure typically takes weeks to months to reach the enforcement stage – not days. Clients should plan accordingly.

The steps above cover the typical pattern. Your matter will turn on specific facts: where the money went, how fast it moved, and which forums can act in time. A confidential case review tells you whether a full mandate is the right instruction. Reach us at info@axiomtracel.com.

Myths About Cross-Border Enforcement

The most common misconception we address is that a foreign judgment automatically reaches assets abroad. It does not. A judgment from one court does not compel a bank, registrar, or exchange in another jurisdiction to do anything. Recognition and enforcement proceedings are required in each jurisdiction where relief is sought. Those proceedings take time, follow local procedure, and require local counsel to file. The New York Convention eases this for arbitral awards – but does not make it automatic, and its application varies by jurisdiction and subject matter.

The second misconception is that a worldwide freezing order freezes everything, everywhere, immediately. A worldwide freezing order is a powerful instrument. It creates an obligation on the defendant, backed by contempt of court, to preserve assets globally. But it is not self-executing. Enforcing it against assets in a third jurisdiction requires steps in that jurisdiction. The order itself is often the most important starting point; the follow-through is where the mandate earns its function.

Third – and this matters for clients who have been approached by operators offering guaranteed recovery – no recovery specialist can promise a return. Any offer of guaranteed recovery, or a service structured primarily around an upfront fee with a promise of return, is a signal of a recovery scam layered on top of the original fraud. Axiom Trace does not offer or imply guarantees. We describe what is possible, what is realistic, and what it will cost to find out. That is the appropriate posture for an independent specialist. If you have been approached by someone promising guaranteed return of funds, see our cross-border enforcement analysis for context on how these secondary frauds operate in a recovery context.

A Mandate in Practice: What the Process Looks Like on the Ground

Consider a matter in Southeast Asia, late 2024, involving funds in the high seven figures diverted from a joint-venture account through a series of payments to entities in two offshore financial centres. The claimant, an insolvency practitioner, had a judgment but no executing mechanism. The assets had already moved through a VASP and partially into a stablecoin wallet.

Triage identified two live forums: one common-law jurisdiction with the debtor's known nominee directorship, and a second with a VASP subject to local regulatory supervision. Applications for a proprietary injunction and a disclosure order against the VASP ran in parallel. The VASP disclosure produced wallet attribution data. The stablecoin balance – still on-chain – was frozen within days of instruction after the issuer was served with appropriate legal process. The fiat component required recognition of the judgment in the offshore centre, coordinated with local counsel.

The insolvency practitioner's estate did not recover everything. Some funds had already converted and dispersed beyond the tracing window. But a material portion was preserved, and enforcement is continuing. The lesson the practitioner identified: had instruction come three weeks earlier, the conversion step would not have completed.

A second matter, in the Gulf region, winter 2025, involved a business-email compromise with funds in the mid-six figures routed to accounts across three jurisdictions within 48 hours of the initial transfer. Here the cross-border angle was immediate: the funds had cleared the originating bank before the client realised the instruction was fraudulent. Bankers Trust orders and third-party disclosure in two jurisdictions produced account records that allowed tracing to a beneficiary account. A domestic freezing injunction in the beneficiary's home jurisdiction followed. Enforcement is pending local counsel's filing of recognition proceedings.

These cases are representative of the complexity the mandate is designed for. They are not predictions of outcome in any other matter.

Frequently Asked Questions

Q: How long does it take to freeze assets?

A: A without-notice freezing application in a common-law court can be heard within hours of filing, if urgency is established and the evidence is ready. From instruction to a court order, the range is typically one to five working days in a cooperative forum. The binding constraint is usually evidence preparation, not the court's availability. Once the freeze is granted, enforcement in secondary jurisdictions adds further time – often weeks – depending on local procedure and the cooperation of local counsel.

Q: Does a foreign judgment automatically reach assets abroad?

A: No – this is one of the most persistent misconceptions in cross-border enforcement. A judgment from one court has no direct legal force over assets or parties in another jurisdiction. Recognition and enforcement proceedings must be brought in each jurisdiction where assets sit. For arbitral awards, the New York Convention provides a widely available framework for recognition, but local procedure still governs the filing and the court must be satisfied that recognition is appropriate. There is no automatic mechanism.

Q: What must be in place before a freezing order is granted?

A: Courts granting interim freezing relief typically require three things: a good arguable case on the underlying claim; a real risk that the defendant will dissipate assets if not restrained; and a cross-undertaking in damages from the applicant, meaning the claimant must be willing to compensate the defendant if the order later proves to have been wrongly granted. In practice, the evidence of dissipation risk is the most contested element. Prior asset movements, the use of nominee structures, or sudden corporate changes are all relevant. The application is typically made without notice; candour to the court about known weaknesses in the case is obligatory.
